The Spanish Supreme Court has now published the much-awaited Judgment on the PRESTIGE. In this short article we consider the findings of the court against the P&I Club and the implications of this ruling in Spain in relation to the right of direct action against marine insurers and where the marine insurance policy is subject to a foreign law.
